1. Agreement to Terms

These Terms & Conditions (“Terms”) govern your access to and use of ericemanuelyankees.com (the “Site”) and any purchase you make from us (“we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Eligibility & Account

• You must be at least the age of majority in your state or province of residence to purchase from the Site. If you are under 18, you may use the Site only with involvement of a parent or guardian.
• You are responsible for providing accurate information and for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account.
• We may refuse service, terminate accounts, or cancel orders at our discretion where permitted by law.

3. Orders & Acceptance

• By placing an order, you make an offer to purchase the products selected under these Terms. We may accept or reject your order at our sole discretion.
• Order confirmation emails acknowledge receipt but do not constitute acceptance. Acceptance occurs when we dispatch the products and send a shipping confirmation.
• In limited-release or high-demand drops, carting an item does not reserve it. Orders may be cancelled if stock is unavailable or suspected fraud is detected.
• Pre-orders (if offered) are charged at checkout and ship once stock is available. Estimated dates are not guarantees and may change.

4. Pricing, Taxes & Payments

• All prices are shown in USD unless otherwise stated. Prices are subject to change without notice.
• Applicable taxes and shipping fees are calculated at checkout based on your delivery address.
• We accept major payment methods as indicated at checkout (e.g., Visa, Mastercard, PayPal). By submitting payment information, you represent you are authorized to use the chosen method.
• Transactions may be processed by third-party payment processors. We may place a temporary authorization hold. Orders may be cancelled if payment cannot be authorized or is flagged by our fraud checks.
• Promotional pricing may be time-limited and subject to exclusions. Pricing errors may be corrected; if an error affects your order, we will contact you to reconfirm or cancel and refund.

5. Shipping & Delivery

• We currently ship within the United States unless otherwise noted at checkout. Processing typically takes 1–3 business days (Mon–Fri, excluding holidays). Peak periods or special releases may require additional time.
• Delivery timelines are estimates provided by carriers and are not guaranteed. Once an order is handed to the carrier, the risk of loss transfers to you.
• Please ensure your shipping address is complete and accurate. We are not responsible for deliveries to incorrectly supplied addresses or for carrier delays.
• Some orders may require a signature upon delivery at our discretion. If a package is returned as undeliverable, we will contact you for reshipment arrangements (additional fees may apply) or a refund less shipping.
• Tracking details will be provided when available.

6. Returns, Exchanges & Cancellations

• To be eligible, items must be unworn, unwashed, and in original condition with tags and packaging. Final sale items, limited releases, and certain accessories may be non-returnable.
• Size exchanges are subject to stock availability at the time we process your return.
• Order changes or cancellations may be requested promptly after purchase but are not guaranteed once processing begins, especially during limited drops.
• Shipping fees are generally non-refundable unless required by law or due to our error. Restocking fees may apply where stated in our returns policy.

7. Product Information & Availability

• We strive to display product colors, images, and descriptions accurately; however, actual colors may vary due to monitor settings and lighting.
• Sizes are approximate and may vary by batch or style. Refer to size guidance if provided.
• All products are offered in limited quantities. We do not guarantee future restocks.
• We reserve the right to discontinue any product at any time.

8. Authenticity & Quality

• All items we sell are sourced through vetted channels and are verified for authenticity prior to shipment.
• Quality checks are performed; minor variations can occur with limited-batch production.

9. Promotions, Gift Cards & Credits

• Promotional codes are single-use unless stated, cannot be combined, and may exclude certain releases or categories.
• Promotions cannot be applied retroactively to previous purchases or after an order is placed.
• Store credits or gift cards (if offered) are not redeemable for cash (except where required by law) and are subject to stated expiry and terms.

10. Intellectual Property

• The Site, including text, graphics, logos, photos, and other content, is owned by or licensed to us and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without prior written permission.
• We are an independent retailer. We are not affiliated with, endorsed by, or sponsored by Eric Emanuel, Major League Baseball, or the New York Yankees. All trademarks, names, and product images remain the property of their respective owners.

• Subject to applicable law, you agree to submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York, for the resolution of any claims not subject to informal resolution.
• Nothing limits your statutory rights that cannot be waived by contract.
